What Delaware law requires of wholesalers

  • SB 201, signed June 1, 2026, defines wholesaling as the business of contracting with an owner to profit by marketing and assigning your equitable interest in the agreement of sale. It covers 1–4 family residential property and land zoned for it.
  • The license requirement takes effect 270 days after enactment (February 26, 2027), giving existing wholesalers time to get licensed. The bill also raises the Real Estate Guaranty Fund claim limit from $25,000 to $50,000.
  • The consumer protections took effect 90 days after enactment (late August 2026): the agreement must include Commission-approved disclosures, and the seller can cancel until midnight of the 21st calendar day after signing, with any deposit refunded within 10 business days of the cancellation notice.
