How to Wholesale Real Estate in Texas
Texas is one of the most active wholesaling markets in the country, and one of the clearest on the rules: you can assign your own purchase contract without a license, but only if you tell both the seller and your buyer, in writing, exactly what you are selling.

The law
What Texas law requires of wholesalers
- Since January 1, 2024, the disclosure has to be in writing and has to go to the seller as well as potential buyers. Before that, the rule only covered buyers.
- The disclosure is what keeps you out of brokerage. If you skip it, Texas treats the deal as unlicensed brokerage, which is a Class A misdemeanor and exposes you to TREC action.
- Market the contract, never the house. “Assignment of contract available on a 3/2 in Pasadena, $12,000 assignment fee” is fine; “House for sale” when you do not hold title is not.

Do I need a real estate license to wholesale in Texas?

What changed in Texas wholesaling law in 2024?
