What Florida law requires of wholesalers
- Under Chapter 475, performing broker services for another person for compensation without a license is a third-degree felony. That is the risk wholesalers need to manage.
- You stay on the right side of the line by acting as a principal: you are the buyer on the contract, you hold an equitable interest, and you assign that interest.
- Advertise your contract, not the property. Listing a house “for sale” with an asking price when you do not own it looks like brokerage.
