  • No wholesaling-specific statute. W. Va. Code 30-40-3 makes it unlawful to act as, or advertise as, a real estate broker or salesperson without a license.
  • W. Va. Code 30-40-4 defines a broker as anyone who, for compensation, lists, sells, purchases, exchanges or options any interest in real estate, helps procure a prospect for a real estate transaction, or advertises those services. Marketing a house you do not own, or finding buyers for someone else’s property, fits that language.
  • In the 2026 session, HB 4493, the proposed Real Estate Wholesaling Accountability Act, would have banned wholesaling. It was introduced and referred to committee but did not become law. Watch future sessions.
