What Indiana law requires of wholesalers

  • IC 32-21-16.5 applies to unlicensed people soliciting homeowners to sell a residential single-family home. It excludes buyers who intend to take title and record the deed, so it is aimed squarely at wholesalers who plan to assign.
  • The disclosure goes on every channel: mailers, postcards, yard signs, websites, email, texts, calls, and social media. It must be legible and in plain sight in writing, and clear and audible on the phone.
  • If the disclosure falls short, the homeowner may nullify the agreement by written rescission within two days with no liability, and a violation is a deceptive act the attorney general can enforce.
